By accessing or using Helios ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Helios is a macOS application that provides AI-powered writing assistance across all applications on your Mac. The Service offers:

  • Free Tier: Use with your own API keys from AI providers
  • Standard Tier: Access to GPT-5 mini and GPT-5 nano models via our cloud service
  • Pro Tier: Access to premium AI models including GPT-5.2, GPT-5.1, GPT-5, and more

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Subscription and Payment

Paid subscriptions are billed on a recurring basis (monthly or yearly). You agree that:

  • Subscriptions automatically renew unless cancelled
  • You authorize us to charge your payment method for recurring fees
  • Fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • You can cancel your subscription at any time through your account dashboard

5. Acceptable Use

You agree NOT to use Helios to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Generate harmful, abusive, or illegal content
  • Attempt to reverse engineer or hack the Service
  • Resell or redistribute the Service without authorization
  • Use the Service for automated or bulk processing beyond reasonable personal use

6. API Keys and Third-Party Services

When using your own API keys (Free Tier):

  • You are responsible for complying with the AI provider's terms of service
  • You are responsible for any costs incurred with the AI provider
  • We store API keys securely in your macOS Keychain but are not responsible for unauthorized access
  • We do not control or guarantee the availability of third-party AI services

7. Intellectual Property

Helios and its original content, features, and functionality are owned by Helios and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to the content you create using Helios. AI-generated content may be subject to the terms of the underlying AI provider.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free operation
  • The accuracy or quality of AI-generated content
  • That the Service will meet your specific requirements
  • The availability of third-party AI services

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9. Accessibility Requirements

Helios requires macOS Accessibility permissions to function. By using the Service, you acknowledge that:

  • The app needs to read selected text from other applications
  • You grant these permissions voluntarily
  • We use these permissions solely to provide the Service functionality
  • We do not log, store, or transmit your text content except to AI providers for processing

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. You may terminate your account at any time by contacting us or using the account deletion feature.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
